TERMS AND CONDITIONS OF USE

1 Purpose

These Terms and Conditions of Use (the “TCUs”) govern access to and use of the service provided by HOMEOCO (the “Service”). They define the obligations of HOMEOCO and of the natural or legal persons using the Service (the “Users”).

Use of the Service is subject to acceptance of these TCUs by ticking the box provided for this purpose. Users are invited to review these TCUs before using the Service by clicking the link displayed when opening the Service, when subscribing to a plan, and at any time at the following address.

HOMEOCO may modify these TCUs at any time. The new TCUs shall apply to Users from the date they are published online. For Users holding a subscription, the new TCUs shall apply under the conditions set out in the Terms and Conditions of Sale.

2 Identification of the Service Provider

The Service is published and provided by HOMEOCO, a simplified joint-stock company (SAS) with a share capital of €1,088, registered with the Grenoble Trade and Companies Register under number 938 438 645 and with VAT number FR72938438645, represented by its President, Clémence Charmoille.

3 Description of the Service

The Service is a digital documentary and educational tool. Its purpose is to help Users better understand the homeopathic approach through content derived from the available reference literature. It facilitates access to information about homeopathy and provides a digital version of homeopathic reference books available online and in bookstores, offering a more modern experience through its intelligent search engine and greater safety through numerous reminders regarding conditions of use and the limitations of homeopathy.

The Service is a conversational agent based on a generative artificial intelligence large language model (LLM), configured and supervised to provide responses (the “Output Data”), based on the available literature (homeopathic remedy databases, materia medica, repertories, etc.), from the questions and information supplied by the User (the “Input Data”).

However, the Service is not intended to be used as a diagnostic support tool, a prescribing tool, or for any specific case. The Service is not a medical device. Nor is it intended to promote one therapy or medication over another.

4 Access to the Service

The Service is available online at: https://homeoco.fr/en/

The Service is available in two versions:

  • A “Discovery” version intended for beginners wishing to discover homeopathy. This version allows users to become familiar with homeopathic case-taking. It is available through two offers:
    A “freemium” offer freely accessible, without an account and free of charge, including limited functionalities, notably restricted access to the educational pathway, no history, and limitations on consultations and displayed results.
    A “premium” offer available by subscription, including extended functionalities such as access to history, unlimited results, and additional tools.
  • An “Expert” version intended for individuals with a good level of knowledge of homeopathy (trained users or homeopathic professionals). This version provides a direct similarity-search approach based on a previously established and structured case study. The “Expert” version is available by subscription.

The specific conditions applicable to subscriptions are set out in the Terms and Conditions of Sale.

5 User Commitments

The User acknowledges being informed that the Service has limitations inherent to the generative artificial intelligence model on which it is based and that the Output Data may contain errors, approximations, or inappropriate responses. The User acknowledges that human verification of the relevance of the Output Data is necessary and that the Service cannot replace human expertise and advice, particularly that of healthcare professionals.

The User undertakes to use the Service solely for educational purposes and in accordance with its intended purpose. The User shall not use the Service to assist in diagnosing or prescribing for the benefit of any specific individual.

The User undertakes to use the Service in compliance with applicable laws and regulations, including any ethical and professional rules applicable to their activity.

The User undertakes to provide, as Input Data, only information for which they hold the necessary rights, licenses, or authorizations. The User further undertakes not to provide directly identifiable data or personal data relating to third parties and to anonymize or generalize the situations described.

The User is solely responsible for their use of the Output Data.

The User undertakes to use the Service fairly and in good faith, without seeking to infringe the rights of third parties or those of HOMEOCO. The User shall not attempt to misuse the Service, circumvent technical restrictions, perform reverse engineering, or exploit security vulnerabilities.

6 HOMEOCO Commitments

HOMEOCO uses its best efforts to keep the Service up to date with respect to the documentary sources it relies upon, insofar as those sources remain accessible. This constitutes an obligation of means.

HOMEOCO implements the necessary resources to ensure access to and operation of the Service 24 hours a day, 7 days a week, for all Users. HOMEOCO also uses its best efforts, in accordance with industry standards, to provide and secure the Service. HOMEOCO cannot guarantee absolute and uninterrupted accessibility or availability of the Service and is therefore only bound by an obligation of means.

The Service may be temporarily interrupted, including but not limited to maintenance operations, updates, bug fixes, or modifications to certain features. Such interruptions shall be kept as short as possible and, whenever feasible, Users shall be informed in advance, except in emergencies.

In the event of prolonged unavailability of the Service or any issue affecting its operation or security, HOMEOCO shall make commercially reasonable efforts to remedy the situation. If HOMEOCO is unable to resolve the issue, the User will be invited either to (I) continue using the Service as is, or (II) discontinue use of the Service.

7 Limitation of Liability

Despite the efforts made, the Service may generate Output Data containing errors, approximations, or inappropriate responses. HOMEOCO seeks to minimize such occurrences but cannot entirely prevent them, as they are inherent limitations of the generative artificial intelligence model on which the Service is based.

Furthermore, HOMEOCO is not responsible for the content of the sources used to generate the Output Data. The Output Data shall not be considered as reflecting HOMEOCO’s views nor imply any endorsement by HOMEOCO.

The Service is provided "AS IS" without any warranty of any kind, whether express or implied, regarding its quality, reliability, fitness for a particular purpose, availability, performance, or results. HOMEOCO shall not be held liable either for the content of the Service’s Output Data or for the manner in which it is used by the User.

The Service may contain links to third-party websites or services. HOMEOCO exercises no control over such content and shall not be held liable for its availability or content.

HOMEOCO shall not be liable for indirect damages, including loss of data or profits, resulting from the use of the Service or arising during the performance of these TCUs.

HOMEOCO shall not be liable in any circumstances where the Service has been used in breach of these TCUs and where the damage results from the User’s fault or negligence.

In any event, and subject to any mandatory legal provisions, HOMEOCO’s total liability, regardless of the cause or legal basis invoked, for all damages combined, shall be limited:

  • for Users accessing the Service free of charge, to the amount of fifty euros (€50);
  • for Customers holding a paid subscription, to the total amount actually paid by the Customer during the twelve (12) months preceding the event giving rise to liability.

Any request must be submitted in writing and clearly describe the issue encountered.

9 Intellectual Property

The Input Data remains the responsibility of the User, who warrants that they possess the necessary rights to use it. Subject to third-party rights, the User may use the Output Data returned to them in compliance with these TCUs. HOMEOCO is authorized to process the Input Data and Output Data solely for the purpose of providing, securing, maintaining, and improving the Service, without claiming any exclusive rights over such data.

All elements of the Service (trademarks, logos, interface, architecture, databases, texts, editorial content, etc.) are the property of HOMEOCO and are protected by intellectual property laws.

The User is granted only a right of consultation and use of these elements, which is personal, non-exclusive, non-transferable, non-sublicensable, non-assignable, and limited to the territory in which the Service is accessible and to the duration of use of the Service. This right is subject to compliance with these TCUs and with all applicable laws, regulations, and standards.

Any unauthorized reproduction, representation, extraction, or exploitation is prohibited.

10 Processing of Personal Data

HOMEOCO may process Users’ personal data in connection with the use of the Service.

The manner in which such personal data is used is described in the Privacy Policy.

11 Sanctions for Non-Compliance with the TCUs

HOMEOCO may suspend access to the Service in the event of fraud, damage to the Service, or a serious breach of these TCUs. HOMEOCO shall inform the User of the contemplated sanction by any means available to it and shall provide the User with a reasonable period, depending on the circumstances, to comply with their obligations.

12 Indefinite Duration

These TCUs are entered into for an indefinite period.

13 Applicable Law – Complaints – Disputes

These TCUs are governed by French law.

In the event of a complaint, the Customer shall submit their request directly to HOMEOCO either by post at HOMEOCO’s postal address or by email at: contact@homeoco.fr

If this attempt is unsuccessful and the Customer is a consumer within the meaning of the French Consumer Code, they may resort to conventional mediation proceedings or any other alternative dispute resolution method and, in particular, may contact, free of charge and within one year of the complaint, the competent consumer mediator:

Failing this, the legally competent courts shall have jurisdiction at the initiative of the most diligent party.
