General Terms and Conditions of Sale

1 Purpose

These general terms and conditions of sale (the “GTC”) are intended to govern the relationship between HOMEOCO and its customers (the “Customer”) in the context of the provision of the service (the “Service”) offered by HOMEOCO. Together with the general terms of use (the “GTU”), they constitute the contract with the Customer (the “Contract”). The Customer declares that they have read these GTC and accepted them before placing their order.

2 Identification of the Service Seller

The Service is edited, provided and sold by HOMEOCO, a simplified joint‑stock company (SAS) with a capital of €1088, registered with the Grenoble Trade and Companies Register under number 938 438 645 and with the intra‑community VAT number FR72938438645, represented by its President Clémence Charmoille.

3 Service Description

The Service is a digital documentary and educational tool. It is intended to help Users better understand the homeopathic approach using content from available reference literature. It facilitates access to information about homeopathy and offers a digital version of homeopathy manuals available online and in bookstores, both more modern thanks to an intelligent search engine and more secure thanks to numerous reminders about usage conditions and the limits of homeopathy.

The Service is a conversational agent, based on a generative large language model (LLM) artificial intelligence, specifically trained to provide, from the questions and indications supplied by the User (the “Input Data”), responses (the “Output Data”) based on the available literature (homeopathic strain databases, materia medica, repertory, etc.).

However, the Service is not intended to be used as a diagnostic or prescription aid, nor for any specific case. The Service is not a medical device. The Service also does not aim to promote one therapy over another or any medication.

The Service is offered in two versions:

  • A “Discovery” version that is aimed at beginners who want to discover homeopathy. This version allows them to start learning homeopathic questioning. This version is offered in two offers:
    A “freemium” offer freely accessible, i.e., without an account and free of charge, which includes limited features, notably restricted access to the educational pathway, no history, with limitations on consultation and result display. This offer is not covered by these GTC.
    A “premium” offer available by subscription, which includes extended features, notably access to history, unlimited results and complementary tools.
  • An “Expert” version that is aimed at persons with a good level of homeopathy knowledge (already trained or homeopathy professionals). This version offers a direct similarity search approach with an already established case study. The “Expert” version is available by subscription.

4 Subscription Plans

The Service is offered on a subscription – monthly or yearly – at the following rates:
• Discovery Service: 12 euros incl. VAT per year
• Expert Service: choose
◦ Monthly rate of 12 euros incl. VAT (i.e., 10 euros excl. VAT + applicable VAT) per month,
◦ Annual rate of 120 euros incl. VAT (i.e., 100 euros excl. VAT + applicable VAT) per year.

Subscriptions are taken without a fixed‑term commitment.

For prices indicated excl. VAT, the applicable VAT amount is added at checkout in accordance with current regulations.

The Customer selects the Service version and the subscription plan they wish during online subscription. The effective start date of the subscription period is set to the date of receipt of the first payment. The subscription is automatically renewed for periods equal to each subscription anniversary date. The Customer may terminate their subscription under the conditions set out in the Termination article.

5 Minimum Technical Configuration

Using the Service requires a minimum technical configuration, namely:

  • A computer equipment including a recent and compatible computer, tablet or mobile phone;
  • Use of one of the following internet browsers, in a version maintained by their publishers: Google Chrome, Mozilla Firefox, Safari or Microsoft Edge;
  • A high‑speed internet connection;
  • As the Service is offered via a responsive design interface, a display adapted to the main screen formats is necessary for optimal use.

It is the Customer’s responsibility to have web access and ensure the compatibility of their computer environment with the Service, under their own responsibility, to subscribe to internet access with the provider of their choice and to acquire any equipment meeting the configuration requirements.

HOMEOCO disclaims any liability and shall have no obligation to refund or compensate in case of non‑functioning or malfunction of the Service due to lack of internet connectivity or failure to meet the minimum technical configuration requirements.

6 Service Subscription

The Service subscription is carried out online.

To access the Service, the Customer must:

  • Select on the site www.homeoco.fr the desired Service version,
  • Create a client account,
  • Complete the payment information,
  • Accept these GTC,
  • Make the first payment, due at order.

Access to the Service is granted after payment validation, except in case of technical incident or need for additional verification, notably for fraud prevention.

To create their account, the Customer must fill in the mandatory fields on the registration form. The Customer commits to providing truthful, complete and up‑to‑date information in order to guarantee its accuracy during the term of their contractual relationship with HOMEOCO. HOMEOCO reserves the right to refuse access to the Service if the Customer provides false, incomplete or erroneous information.

Access to the created client account is protected by a username and password chosen by the Customer during their registration for the Service. The Customer is solely responsible for any use of their username and password, and solely guarantees their confidentiality, as well as any use of their account.

7 Payment Terms

Payment of the first installment is required upon subscription and conditions access to the Service. Payments are processed by the secure payment provider Stripe. Payments will be made in accordance with the conditions applicable to the service provided by Stripe, which the Customer expressly accepts: https://stripe.com/fr/legal/consumer

In case of payment failure, access to the Service may be suspended until regularisation or terminated under the conditions set out in the Termination article.

The prices applicable to the Customer are those displayed at the time of subscription and may evolve in the future, without retroactive effect on the current subscription period.

8 Immediate Execution and No Consumer Right of Withdrawal

The consumer right of withdrawal does not apply to this Contract. Prior to concluding the Contract, the Customer is invited to consent to the Contract starting before the withdrawal period expires and acknowledges that they will lose their right of withdrawal. This Customer agreement is confirmed by an email sent by HOMEOCO after the Contract is concluded.

9 Termination at the Customer’s Initiative

The Customer may terminate their subscription at any time from their Account area or by contacting HOMEOCO at the following email address: contact@homeoco.fr

Termination takes effect at the end of the period – monthly or yearly – according to the subscription plan currently subscribed and paid.

Subject to mandatory legal provisions, no refund will be granted.

10 Suspension and Termination at Homeoco’s Initiative

HOMEOCO may suspend the Contract and access to the Service in case of payment default. In the absence of regularisation within one month from the suspension date, the Contract will be terminated automatically.

HOMEOCO may also terminate the Contract in case of fault, such as fraud or attempted fraud or a serious breach of the Contract. The termination may occur after a period of one month from the sending to the Customer of an email indicating the alleged fault and inviting them to remedy it, if no effect follows.

11 Modification of the GTC

HOMEOCO reserves the right to modify at any time, at its sole discretion, all or part of these GTC and commits to inform the Customer in advance of any modification before it comes into force.

The new GTC will apply to the Customer only from the renewal of the Contract.

The Customer who opposes the application of the new GTC may terminate their subscription under the conditions set out in article 10.

12 Governing Law – Claims – Disputes

These GTC are governed by French law.

In case of a claim, the Customer shall send their request directly by mail to HOMEOCO’s postal address or to the following email address: contact@homeoco.fr

If this attempt fails, when the Customer is a consumer within the meaning of the Consumer Code, they may resort to a conventional mediation procedure or any other alternative dispute resolution method, notably by using, free of charge, within one year from their claim, the competent consumer mediator: CM2C, 49 Rue de Ponthieu, 75008 PARIS, phone: 01 89 47 00 14, https://www.cm2c.net 

Otherwise, the legally competent courts shall be seized by the most diligent party.
