1 Purpose

These Terms and Conditions of Sale (the “T&Cs”) govern the relationship between HOMEOCO and its customers (the “Customer”) in connection with the provision of the service (the “Service”) offered by HOMEOCO. Together with the Terms and Conditions of Use (the “TCUs”), they constitute the agreement between HOMEOCO and the Customer (the “Agreement”). The TCUs are available at the following address.

The Customer acknowledges having read and accepted these T&Cs before placing an order.

2 Identification of the Service Provider

The Service is published, provided, and sold by HOMEOCO, a simplified joint-stock company (SAS) with a share capital of €1,088, registered with the Grenoble Trade and Companies Register under number 938 438 645 and with VAT number FR72938438645, represented by its President, Clémence Charmoille.

3 Description of the Service

The Service is a digital documentary and educational tool. Its purpose is to help Users better understand the homeopathic approach through content derived from available reference literature. It facilitates access to information about homeopathy and provides a digital version of homeopathic reference books available online and in bookstores, offering a more modern experience thanks to its intelligent search engine and greater safety through numerous reminders regarding conditions of use and the limitations of homeopathy.

The Service is a conversational agent based on a generative artificial intelligence large language model (LLM), specifically trained to provide responses (the “Output Data”) based on the available literature (homeopathic remedy databases, materia medica, repertories, etc.) from the questions and information supplied by the User (the “Input Data”).

However, the Service is not intended to be used as a diagnostic support tool, a prescribing tool, or for any specific case. The Service is not a medical device. Nor is it intended to promote one therapy or medication over another.

The Service is available in two versions:

  • A “Discovery” version intended for beginners wishing to discover homeopathy. This version allows users to become familiar with homeopathic case-taking. It is available through two offers:
    A “freemium” offer freely accessible, without an account and free of charge, including limited functionalities, notably restricted access to the educational pathway, no history, and limitations on consultations and displayed results. This offer is not covered by these T&Cs.
    A “premium” offer available by subscription, including extended functionalities such as access to history, unlimited results, and additional tools.
  • An “Expert” version intended for individuals with a good level of knowledge of homeopathy (trained users or homeopathic professionals). This version provides a direct similarity-search approach based on a previously established and structured case study. The “Expert” version is available by subscription.

4 Subscription Plans

The Service is offered on a subscription basis – monthly or annual – at the following rates:
• Discovery Service: €12 incl. VAT per year
• Expert Service: either
◦ Monthly rate of €12 incl. VAT (i.e., €10 excl. VAT + applicable VAT) per month,
◦ Annual rate of €120 incl. VAT (i.e., €100 excl. VAT + applicable VAT) per year.

Subscriptions are entered into without any minimum commitment period.

For prices indicated excluding tax (excl. VAT), the applicable VAT amount is added during checkout in accordance with current regulations.

The Customer chooses the Service version and subscription plan during online registration. The effective start date of the subscription period is the date on which the first payment is received. The subscription is automatically renewed for successive periods of equal duration on each anniversary date. The Customer may terminate the subscription under the conditions set out in the Termination article.

5 Minimum Technical Requirements

Use of the Service requires the following minimum technical configuration:

  • A computer device including a computer, tablet, or recent compatible mobile phone;
  • Use of one of the following web browsers in a version maintained by its publisher: Google Chrome, Mozilla Firefox, Safari, or Microsoft Edge;
  • Access to a high-speed internet connection;
  • As the Service is provided through a responsive design interface, display compatibility with major screen formats is required for optimal use.

The Customer is responsible for obtaining internet access, ensuring that their technical environment is compatible with the Service, subscribing to internet access from the provider of their choice, and acquiring any equipment meeting the required specifications.

HOMEOCO disclaims all liability and shall have no obligation to refund or compensate the Customer in the event of failure or malfunction of the Service due to lack of internet connectivity or failure to meet the minimum technical requirements.

6 Subscription to the Service

Subscription to the Service is completed online.

To access the Service, the Customer must:

  • Select the desired Service version on www.homeoco.fr/en;
  • Create a customer account;
  • Complete payment information;
  • Accept these T&Cs;
  • Make the first payment, which is due upon ordering.

Access to the Service is granted after payment validation, except in the event of a technical incident or the need for additional verification, particularly for fraud prevention purposes.

To create an account, the Customer must complete the mandatory fields in the registration form. The Customer undertakes to provide accurate, complete, and up-to-date information and to maintain its accuracy throughout the contractual relationship with HOMEOCO. HOMEOCO reserves the right to refuse access to the Service if the Customer provides false, incomplete, or inaccurate information.

Access to the customer account is protected by a username and password chosen by the Customer during registration. The Customer is solely responsible for any use made of their username and password, for maintaining their confidentiality, and for any use of their account.

7 Payment Terms

Payment of the first installment is required upon subscription and conditions access to the Service. Payments are processed by the secure payment provider Stripe. Payments are made in accordance with the terms applicable to the services provided by Stripe, which the Customer expressly accepts: https://stripe.com/fr/legal/consumer

In the event of payment failure, access to the Service may be suspended until regularization or terminated under the conditions set out in the Termination article.

The prices applicable to the Customer are those displayed at the time of subscription and may be modified for future periods, without retroactive effect on the current subscription period.

8 Immediate Performance and Waiver of Consumer Withdrawal Rights**

The consumer right of withdrawal does not apply to this Agreement. Before concluding the Agreement, the Customer is invited to consent to the Agreement beginning before the expiry of the withdrawal period and acknowledges that they will lose their right of withdrawal. This consent is confirmed by an email sent by HOMEOCO after the Agreement has been concluded.

9 Termination at the Customer’s Initiative

The Customer may terminate their subscription at any time from their Account area or by contacting HOMEOCO at the following email address: contact@homeoco.fr

Termination takes effect at the end of the current paid subscription period—monthly or annual, depending on the subscribed plan.

Subject to mandatory legal provisions, no refund will be granted.

10 Suspension and Termination at HOMEOCO’s Initiative

HOMEOCO may suspend the Agreement and access to the Service in the event of non-payment. If payment is not regularized within one month from the suspension date, the Agreement shall be automatically terminated.

HOMEOCO may also terminate the Agreement in the event of misconduct, such as fraud, attempted fraud, or a serious breach of the Agreement. Termination may occur after a period of one month following the sending of an email informing the Customer of the alleged breach and inviting them to remedy it, without effect.

11 Amendments to the T&Cs

HOMEOCO reserves the right to amend all or part of these T&Cs at any time at its sole discretion and undertakes to inform the Customer in advance of any changes before they take effect.

The new T&Cs shall apply to the Customer only upon renewal of the Agreement.

A Customer who objects to the application of the new T&Cs may terminate their subscription under the conditions set out in Article 10.

12 Applicable Law – Complaints – Disputes

These T&Cs are governed by French law.

In the event of a complaint, the Customer shall submit their request directly to HOMEOCO either by post at HOMEOCO’s postal address or by email at: contact@homeoco.fr

If this attempt is unsuccessful and the Customer is a consumer within the meaning of the French Consumer Code, they may resort to conventional mediation proceedings or any other alternative dispute resolution method and, in particular, may contact, free of charge and within one year of the complaint, the competent consumer mediator:

Failing this, the legally competent courts shall have jurisdiction at the initiative of the most diligent party.
