Terms of Use of HOMEOCO

HOMEOCO is a conversational chatbot dedicated to homeopathy, designed to assist consumers in choosing a homeopathic remedy suited to their needs. It provides a selection based on a conversation with the chatbot. It also lists partner professionals or pharmacies.

These Terms of Use (ToU) govern the use of HOMEOCO by users as well as the commitments made by HOMEOCO in providing the service.

Provisions related to the management of personal data are included in the HOMEOCO Privacy Policy, accessible at any time.

1. Definitions

In these ToU, the following terms shall have the following meanings:

  • HOMEOCO : HOMEOCO SAS, a simplified joint-stock company with a capital of 1,000 euros, headquartered at 358 Route d’Uriage, 38320 HERBEYS, registered with the RCS under the number [number].
  • Conversational Chatbot : An interactive automated dialogue interface allowing the User to interact with HOMEOCO to obtain a preliminary selection or information about homeopathy.
  • User Account : A personal account enabling the User to review their exchanges with HOMEOCO and access their history or recommendations.
  • Partner Professional : A healthcare professional trained in homeopathy or a pharmacy, registered and referenced on HOMEOCO.
  • Data : All personal or medical information provided by the User and processed by HOMEOCO.
  • Pre-Selection : An initial evaluation performed by HOMEOCO based on the answers provided by the User during the conversation. This pre-selection is informative and may be confirmed by a homeopathy professional.
  • Service : All features offered by HOMEOCO, including interactions with the chatbot and access to professionals (homeopaths or pharmacies).

2. Acceptance of the Terms of Use

By using HOMEOCO, the User unreservedly accepts these ToU. They are accessible at any time through the chatbot interface. HOMEOCO reserves the right to modify the ToU at any time. Any modification must be accepted by the User to continue using the Service.

3. Services

HOMEOCO offers Users the following services:

  1. Interactive dialogue to identify homeopathy needs based on symptoms reported during the conversation.
  2. Informative pre-selection of remedies based on the User’s answers.
  3. General recommendations on homeopathic treatments suited to the identified needs.
  4. The possibility to find Partner Professionals (homeopaths or partner pharmacies) for confirmation, purchasing treatment, or homeopathic follow-up.
  5. Educational documentation on homeopathy and best health practices.
  6. These services may evolve or be modified at any time, provided that the main functionalities remain available.

4. User Account Creation and Access

4.1 Account Creation

Access to certain HOMEOCO features, such as session history or more than five non-cumulative queries per month, requires the creation of a User Account. To do this, the User must provide their personal information (name, first name, email) and create a password.

If the User is a minor, their legal representative must create and manage the Account.

4.2 Account Access

The User Account is secured with a username and password. The User is responsible for maintaining the confidentiality of these credentials. HOMEOCO cannot be held responsible for unauthorized access due to negligence in their management.

5. Use of the Conversational Chatbot

HOMEOCO is designed to provide information and guide the User on homeopathy options.

5.1 Pre-Selection

HOMEOCO provides a pre-selection based on the information provided by the User during the conversation. This pre-selection is informative and does not replace a medical diagnosis by a healthcare professional.

The User must respond truthfully and accurately to the chatbot’s questions. HOMEOCO disclaims any liability in case of errors due to inaccurate answers.

5.2 Service Limitations

HOMEOCO is not a healthcare professional and does not provide medical diagnoses or prescriptions. The chatbot’s information is general and should be validated by a Partner Practitioner or another qualified healthcare professional if necessary.

6. Partner Professionals

6.1 Access to Partner Professionals

Users can contact a professional (homeopaths or partner pharmacies) to confirm the pre-selection, purchase treatment, establish a treatment plan, or obtain therapeutic follow-up.

6.2 Relationship with the Professional

HOMEOCO does not intervene in the relationship between the User and the Partner Professional. The terms of consultation and medical decisions are the sole responsibility of the Professional.

7. Data Security and Confidentiality

7.1 Data Protection

HOMEOCO implements technical and organizational measures to ensure the security of collected Data, in compliance with applicable laws.

7.2 Data Hosting

User Data is hosted in France on certified servers for processing sensitive data.

7.3 Right of Access and Rectification

Users may, at any time, access their personal Data, request its correction or deletion through the HOMEOCO interface.

8. HOMEOCO’s Responsibility

HOMEOCO is committed to providing a quality Service but is only bound by a best-effort obligation. HOMEOCO cannot be held responsible for decisions made by the User or the consequences of treatment undertaken without confirmation from a healthcare professional.

9. Service Availability

HOMEOCO makes every effort to ensure the availability of its Service. However, temporary interruptions may occur, particularly for maintenance or updates.

10. Account Closure

10.1 Closure by the User

The User may close their Account at any time. Their Data will be retained for 60 days to allow retrieval, then deleted or anonymized.

10.2 Closure by HOMEOCO

HOMEOCO reserves the right to close an Account in case of violation of the ToU.

11. Intellectual Property

All elements of HOMEOCO, including its interface, content, and algorithm, are protected by intellectual property laws. Any unauthorized reproduction or use is prohibited.

12. Applicable Law and Dispute Resolution

These ToU are governed by French law. In case of a dispute, an amicable solution will be sought. If no resolution is found, the matter may be submitted to the competent jurisdiction.
